In short:
- epc.is is a free beta for businesses.
- There is no commitment to availability or features. Keep your own copies of your data.
- We are liable only for intent and gross negligence, and beyond that only where the law makes it mandatory.
- Use the platform fairly, only for numbers and data that are yours, and do no harm.
- Anyone who does not stick to this will be suspended.
The text below is what binds.
1. Provider and scope
epc.is is operated by benelog GmbH & Co. KG, Maarweg 133, 50825 Köln, Germany ("we"). These terms apply to any use of epc.is with a user account, meaning the management interface, the APIs and the publication of data through epc.is and id.epc.is. Terms of the users do not apply.
2. Businesses only
epc.is is offered exclusively to businesses within the meaning of § 14 of the German Civil Code (BGB), to public-law entities and to research institutions. By creating an account you confirm that you are not acting as a consumer. If you act for a company, you confirm that you are authorised to do so.
3. What the beta is
- The beta is free of charge. We provide epc.is without payment and without any claim to particular features, availability, response times or support.
- Features may change, disappear or be temporarily unavailable at any time. We do not always announce maintenance or outages.
- We back up the platform on a best-effort basis, but we do not owe you a backup. Data may be lost. Keep your own copies of everything that matters to you. The export functions and APIs are there for that.
- There is no right to access. We may end the beta at any time. We will announce that by e-mail at least 30 days in advance, so that you can export your data, unless an important reason requires an earlier end.
- Whether and on what terms epc.is continues after the beta is open. A move into a paid offering never happens automatically, only with your express consent.
4. Account and approval
- After registering and confirming your e-mail address you can apply for access to a tenant. We review applications by hand, in particular whether you may act for the company and its GS1 number range. We may decline applications without giving reasons.
- Give true and complete information in your application and keep it up to date.
- Keep passwords, API keys and tokens secret. Actions taken with your credentials count as yours unless you report misuse to us without delay.
5. Your data and publication
- The data you create in your tenant remains your data. You grant us the rights we need to store and process it and to publish it the way you configure. These rights end when the data is deleted.
- Data you mark as public can be retrieved worldwide through GS1 Digital Link addresses, including by scanning a QR code, and may be picked up by search engines and third parties.
- epc.is registers links (linksets) for your GS1 numbers with the GS1 registry. That is GS1's real production environment, not a test system. Entries published there take effect outside epc.is and cannot always be fully withdrawn.
- You alone are responsible for your data being correct and lawful, in particular product information, mandatory information in a digital product passport and environmental claims. epc.is does not check content for accuracy and does not give legal advice.
- The beta is not meant for processing personal data on your behalf. Do not upload personal data other than business contact details in master data (such as the contact person of a location). If you need a data processing agreement beyond that, talk to us.
6. Fair use
In particular, you must not:
- use GTINs, GLNs, GS1 company prefixes or brands that do not belong to you or your company, or pose as another company;
- publish content that is illegal, misleading, offensive or infringes third-party rights;
- distribute malware, phishing pages or redirects to such targets through epc.is or through Digital Link addresses;
- put excessive load on the platform, for example through load tests, bulk retrieval or automated requests beyond normal integration use;
- circumvent security measures, spy on other tenants or test the platform for vulnerabilities without our prior consent. Please report vulnerabilities you find to us confidentially; we appreciate it;
- resell access or offer it to third parties as your own service.
7. Suspension and termination
- If you breach these terms, or your use endangers the platform, other users or third parties, we may remove content or disable access to it, withdraw publications, restrict your access, or suspend or delete your account. We choose the mildest measure that is sufficient.
- We inform you of any such measure by e-mail with a statement of reasons (Art. 17 of Regulation (EU) 2022/2065), usually in advance. In serious cases or where there is a risk, we act immediately and give the reasons afterwards. You can object at any time at info@benelog.com, and we will review the decision.
- You can close your account at any time without notice by e-mailing us. We may end your use with 14 days' notice; the right to suspend immediately under paragraph 1 is unaffected.
- After your use ends, we delete your account and your tenant's data within 30 days, unless the law requires us to keep it. We withdraw entries in the GS1 registry as far as GS1 permits.
8. Reporting illegal content
Anyone who believes content on epc.is is illegal can report it to info@benelog.com. Please give the exact address (URL), explain why the content is illegal, and state your name and e-mail address, unless the report concerns child sexual abuse material. We confirm receipt, decide with care and tell you the outcome.
9. Liability
- Because we provide epc.is free of charge during the beta, we are liable only for intent and gross negligence. Any further liability is excluded, in particular for outages, data loss, lost profits, indirect damage and the accuracy of published data.
- This does not affect liability for injury to life, body or health, under the German Product Liability Act, for fraudulently concealed defects, and in all other cases where liability is mandatory by law.
- Where we are liable for loss of data at all, our liability is limited to the effort that restoration would have required had you made regular backups of your own.
- These rules also apply to our employees, representatives and agents.
10. Indemnity
You indemnify us against third-party claims arising from your content infringing third-party rights or from your breach of these terms, including reasonable costs of legal defence. This does not apply where you are not responsible for the breach.
11. Changes to these terms
We may change these terms, for example when the platform or the law changes. We announce changes by e-mail at least 4 weeks before they take effect. If you do not object by then, the new terms apply; we point out this consequence in the notice. If you object, either side may end the use when the change takes effect.
12. Final provisions
- German law applies, excluding the UN Convention on Contracts for the International Sale of Goods.
- The place of jurisdiction for all disputes is Cologne, Germany, if you are a merchant, a public-law entity or a special fund under public law.
- If a provision is invalid, the others remain valid. The statutory rule takes the place of the invalid provision.
- The German version is binding; the English version is for information.
